FCDL Appeals

The following is helpful information regarding Funding Commitment Decision Letter (FCDL) appeals. 

FCDL Appeals

Once your FCDL is received, review it carefully. If you disagree with anything in the letter, you must submit an appeal within 60 days of the date when USAC issued the decision you are appealing. Appeals must be filed in EPC.

Submitting Your Appeal

You are responsible for drafting your own case. The process in EPC is not just a questionnaire; rather, narrative-style answers must be submitted. You must draft an appeal letter stating why you are requesting an appeal, with supporting information and documentation. This will make it easy for you to copy/paste and attach supporting documentation. All applicants will receive acknowledgment of their appeal upon receipt. USAC reviews all complete appeals and responds with a decision in writing. 

You may want to include the following in your appeal:

  • Documentation of USAC’s initial decision, in the form of a copy of the FCDL

  • Supporting documentation, such as forms and previous correspondence

  • A precise explanation of the relief being sought through the appeal

Failing to submit any missing information to USAC within the prescribed time period could result in the denial of your appeal. Once you complete the appeal process, it could take weeks or months to receive a response. You can always submit a customer service case within EPC to inquire about your appeal.


Your Appeal Response

The decision will be issued as a revised FCDL, which you keep as the official new data. Once you receive the appeal response, if needed, you can appeal that decision through the FCC’s website. This process is called seeking a waiver of FCC rules, and must be submitted to the FCC within 60 days of the date USAC issued the decision.  USAC cannot waive FCC rules.
